Custom Instrument Construction Policies

This is an edited version of my purchase agreement laying out the process and policies of commissioning an instrument.

1. Description of Services

The Builder agrees to construct a custom guitar ("Instrument") according to the specifications provided by the Customer.

2. Price and Payment Terms

A non-refundable deposit of $1000 is required to reserve your place in the build order. 

The base price of your instrument as well as your place in the build order are based on the deposit date. 

The final price of the instrument will be determined prior to the start of the build.

The remaining payment schedule is as follows:

Payment 1: 25% due when the instrument build begins. This is due before any wood is cut. 

Payment 2: 25% due when the instrument is finished “in the white,” prior to any finish work beginning.

Payment 3: The remaining 50% balance plus shipping costs.


Payment may be made via personal check, Venmo or PayPal Friends and Family. Payment by credit card or standard PayPal will incur a 3% processing fee.  

Guitar Base Price: $7500

Ukulele Base Price: $4500

3. Construction and Delivery

The estimated time for the construction of the Instrument is [Estimated Time Frame], commencing on the receipt of the deposit. The Builder will make reasonable efforts to complete the Instrument within this time frame, but the Customer acknowledges that delays may occur. The Builder will communicate any significant delays to the Customer.

4. Approval and Acceptance

Upon completion, the Instrument will be available for the Customer's final inspection. The Customer will have [Number of Days] days to inspect the Instrument and either accept it or provide written notice of any issues to the Builder. Failure to notify the Builder within this period will constitute acceptance of the Instrument.

Should the instrument be returned to the builder a refund (less deposit) will be issued following the sale of the instrument. The customer will be responsible for any required modifications to remove personalization rendering the instrument otherwise non-saleable. For example, the customer’s name inlaid on the guitar. 

5. Warranty

The Builder warrants offers a lifetime warranty to the original owner of the Instrument against defects in materials and workmanship. This warranty does not cover damage due to normal wear and tear, over or under humidification, improper use, or modifications made by anyone other than the Builder.

6. Cancellation

If the Customer wishes to cancel this Agreement prior to the completion of the Instrument, the Customer will forfeit the initial deposit. If cancellation occurs after the Instrument has been completed but before delivery, the Customer will be responsible for the full payment of the Instrument and will be refunded as outlined in #4. 

7. Limitation of Liability

The Builder's liability to the Customer under this Agreement shall be limited to the total amount paid by the Customer. In no event shall the Builder be liable for any special, incidental, or consequential damages.

8. Governing Law

This Agreement shall be governed by the laws of South Dakota.

9. Entire Agreement

This Agreement contains the entire understanding between the Builder and the Customer regarding the subject matter hereof and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written.

10. Amendment

No amendment, modification, or addition to this Agreement shall be effective unless it is in writing and signed by both parties.
